The Constitution of the United States provides that Congress has the power to establish Bankruptcy laws. There are primarily two different types of bankruptcy cases that are used by people to find relief from their debts and obtain a fresh start. Chapter 7 is the most common type of Bankruptcy. It is designed for both individuals and married couples who are having difficulties paying their debts. In most cases you can discharge (wipe out) credit card debts, medical and hospital bills, unsecured personal loans, pay day loans, and certain taxes. In the majority of the cases you will be able to retain most of your property.
Chapter 13 is commonly known as a payment plan Bankruptcy. In many cases individuals and couples are ineligible to file a Chapter 7 due to the fact they may have filed a prior Chapter 7 within eight years or they have too high of an income. They may also need assistance with respect to time to catch up on their house payments or in some cases they may be able to strip down or eliminate a second mortgage on their home.
